Terms of Service

These Terms of Service ('Terms') govern your access to and use of customqrcode.io, including our websites, QR code tools, redirect service, applications, APIs, webhooks, and related services (collectively, the 'Service'). By accessing or using the Service, you agree to these Terms. If you use the Service for an organization, you represent that you have authority to bind that organization, and 'you' includes the organization.
Eligibility
You must be at least 18 years old and legally able to enter into a contract to use the Service. You may not use the Service if applicable law prohibits you from doing so.
The Service
The Service lets you create, customize, save, organize, download, and manage QR codes. Depending on the content type you choose, a QR code may encode content directly or use a link at qr.customqrcode.io that resolves through our redirect service.
Codes that use our redirect service may support destination changes, scan analytics, schedules, passwords, scan limits, routing rules, link-health checks, and other managed features. These features depend on the continued availability of the Service. A code that directly encodes content does not depend on our redirect service after it is downloaded.
We may add, change, limit, or discontinue features. When practical, we will provide notice before a change materially reduces a core feature you are actively using.
Accounts and workspaces
You must provide accurate account information and keep it current. You are responsible for activity performed through your account, for protecting your sign-in credentials, and for promptly telling us if you suspect unauthorized access.
If you invite other people to a workspace, you are responsible for assigning appropriate access and for their use of content in that workspace. A workspace owner may control, export, or delete workspace content and may remove members.
Your content
You retain ownership of the destinations, text, contact details, files, images, designs, templates, integration data, and other materials you submit to the Service ('Customer Content').
You grant us a worldwide, non-exclusive, royalty-free license to host, copy, process, transmit, display, and modify Customer Content only as necessary to provide, secure, maintain, and improve the Service and to comply with law. This license ends when the Customer Content is deleted from our systems, subject to reasonable backup and legal-retention periods described in our Privacy Policy.
You represent that you have all rights and permissions needed for Customer Content and for the destinations to which your codes direct people. You are responsible for the accuracy, legality, accessibility, and safety of Customer Content and destinations, and for providing any privacy notice or consent required when you collect information from people who scan your codes.
Acceptable use
You may not use the Service to:
- Break the law or help another person break the law.
- Distribute malware, facilitate phishing, impersonate another person, deceive scanners about a destination, or interfere with the security of any system.
- Promote or distribute content that is fraudulent, unlawfully threatening, exploitative, or that violates another person's intellectual property, privacy, publicity, or other rights.
- Send spam or other communications that violate applicable marketing or communications laws.
- Probe, scan, or test the vulnerability of the Service without permission; bypass rate limits or access controls; scrape the Service in an abusive manner; or disrupt the Service or other users.
- Reverse engineer the Service except where applicable law expressly permits it, resell access without our permission, or use the Service to build a competing service using our non-public features or data.
- Use automated means in a way that creates unreasonable load or exceeds documented API limits.
QR codes and destinations
You are responsible for testing each QR code before publishing or printing it and after changing its destination or settings. Printing conditions, design choices, damage, camera software, connectivity, destination availability, and third-party services can affect whether a code scans or resolves correctly.
We may block, pause, or disable a code or destination when we reasonably believe it violates these Terms, creates a security risk, exposes us or others to liability, is required to be restricted by law, or threatens the Service. Where practical and lawful, we will notify the account owner.
Deleting your account or a managed code may permanently stop its redirect from resolving. You should not rely on a managed code for emergency communications, safety-critical systems, or any use where a delayed or failed redirect could cause injury or serious harm.
APIs, webhooks, and integrations
If you use an API, webhook, or integration, you must keep credentials and signing secrets secure, follow the applicable documentation and rate limits, and use data received through the Service only as permitted by law and these Terms.
Third-party integrations are provided by their respective operators and may have separate terms and privacy policies. You authorize us to exchange the data needed to perform actions you request through an integration. We are not responsible for a third party's service, availability, security, or handling of data.
Our intellectual property
We and our licensors own the Service, including its software, design, documentation, trademarks, and other materials, excluding Customer Content. These Terms give you a limited, non-exclusive, non-transferable, revocable right to use the Service in accordance with these Terms. They do not transfer ownership of the Service to you.
If you send us feedback, you grant us a perpetual, worldwide, irrevocable, royalty-free right to use it without restriction or compensation, provided we do not identify you publicly without permission.
Privacy
Our Privacy Policy explains how we collect, use, disclose, and retain personal data. If you use the Service to process personal data about scanners or other people, you are responsible for determining the notices, consents, agreements, and other safeguards required for your use.
Suspension and termination
You may stop using the Service at any time. You may delete your account using the account settings, subject to any workspace-ownership steps shown there.
We may suspend or terminate access if you materially or repeatedly violate these Terms, create a security or legal risk, fail to respond to a legitimate abuse report, or if we are legally required to do so. When the issue can be resolved safely, we may give you an opportunity to correct it first.
Sections that by their nature should survive termination will survive, including ownership, disclaimers, limits of liability, indemnification, and general terms.
Service availability and disclaimers
We work to keep the Service available and secure, but we do not guarantee uninterrupted or error-free operation, that every QR code will scan on every device, that every redirect or third-party destination will remain available, or that Customer Content will never be lost.
To the fullest extent permitted by law, the Service is provided 'as is' and 'as available' without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. Some jurisdictions do not allow certain warranty exclusions, so some of these exclusions may not apply to you.
Limitation of liability
To the fullest extent permitted by law, neither customqrcode.io nor its suppliers will be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, business, goodwill, use, or data, arising from or related to the Service, even if advised that such damages were possible.
To the fullest extent permitted by law, our total liability for all claims arising from or related to the Service or these Terms will not exceed the greater of 100 US dollars or the amount you paid us for the Service during the 12 months before the event giving rise to the claim. These limits do not apply where applicable law does not permit them.
Indemnification
To the extent permitted by law, you will defend, indemnify, and hold harmless customqrcode.io and its personnel from claims, damages, losses, and reasonable expenses arising from your Customer Content, your destinations, your violation of these Terms, or your violation of another person's rights. This obligation does not apply to the extent a claim results from our own unlawful conduct.
Changes to these Terms
We may update these Terms as the Service or law changes. We will update the effective date above and, for material changes, provide reasonable notice through the Service or by email before the changes take effect when required by law. Your continued use after the effective date means you accept the updated Terms.
General terms
These Terms and any dispute arising from or relating to them or the Service are governed by the laws of the State of Nevada, United States, without regard to conflict-of-law principles.
These Terms and any policies they incorporate are the entire agreement between you and us about the Service. If a provision is unenforceable, it will be modified only as much as necessary and the remaining provisions will continue in effect. A failure to enforce a provision is not a waiver. You may not assign these Terms without our prior written consent. We may assign them as part of a merger, acquisition, reorganization, or sale of assets, or by operation of law.
Headings are for convenience only. The word 'including' means 'including without limitation.' These Terms do not create a partnership, joint venture, employment, or agency relationship.
